Wide-ranging programs. Peck Shaffer has extensive experience structuring state revolving fund programs for wastewater, drinking water, solid waste and general infrastructure needs, utilizing appropriations-backed, cross-collateralization and leveraging models. We also serve as special tax counsel and rebate analyst (see "TAX AND FINANCIAL ANALYSIS – Rebate Services) for such programs.
Program development from top to bottom. We have experience in assisting with the development of state revolving fund programs from top to bottom, beginning with the drafting of legislation and regulatory rules and continuing through to the structuring of a financing and the preparation of underlying documentation for both governmental and private sector borrowers. We also provide assistance with ongoing program implementation and oversight long after a financing is completed.
Eliminating the "learning curve." We have in-depth knowledge of underlying federal grant programs and methods for leveraging federal and state dollars and unique tax law issues. We seek maximum flexibility for our clients in applying financing strategies and we have advised clients in difficult political environments, including an instance where there was no enacted state budget. The so-called "learning curve" often necessary for establishment of certain types of revolving funds would not be necessary in our case, thus enabling timely structuring of a financing program.
Consistent service. As a testimony to the consistency of our services, we have been appointed as bond counsel to the Kentucky Infrastructure Authority since its inception, being continually selected following the regularly recurring request for proposals process mandated by state law. Additionally, over the past decade, we have served as underwriter's counsel for nearly $1 billion of financings of the Ohio Water Development Authority, which operates several programs, including Ohio's federally funded state revolving fund.
